1. About Sportster

Sportster Inc. (“Sportster,” “we,” “us,” or “our”) is a federally incorporated company registered in British Columbia, Canada. We operate an online marketplace (“Platform”) that connects sports venue operators (“Venue Operators”) with end users (“Players”) for the purpose of booking sports facilities and organizing recreational activities.

Sportster is a marketplace intermediary. We are not a venue operator, and we are not responsible for the condition, safety, or operations of any venue listed on the Platform.

2. Acceptance of Terms

By creating an account or using the Platform, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use the Platform. These terms apply to all users — Players, Venue Operators, and platform administrators.

3. Account Registration

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials. You must be at least 19 years of age to create an account independently, or have verifiable parental/guardian consent if you are between 13 and 18.

4. Platform Use

You may use the Platform only for lawful purposes. Prohibited activities include:

  • Creating false or misleading venue listings
  • Making fraudulent bookings or chargebacks
  • Harassing, threatening, or abusing other users
  • Circumventing our payment systems
  • Violating any applicable Canadian federal or provincial law
  • Attempting to reverse-engineer or scrape the Platform

5. Bookings and Payments

All payments are processed by Stripe, Inc. Sportster does not store payment card information. When you make a booking, you agree to pay the listed price plus any applicable taxes. Sportster charges a platform fee (currently 10% of the booking amount, subject to change) which is disclosed prior to payment.

Prices displayed are inclusive of applicable Canadian Goods and Services Tax (GST) where applicable. Sportster may be required to collect and remit GST on platform service fees.

5a. Stripe Connect — Venue Operator Payout Accounts

Venue Operators who accept bookings through Sportster must connect a Stripe Express account. Stripe Express is a payment account created through Sportster's integration with Stripe, Inc. (“Stripe”) under the Stripe Connected Account Agreement.

Important disclosures about Stripe Express accounts:

  • Platform-managed access: Stripe Express accounts are created and managed on your behalf through Sportster. You access your Express payout dashboard by logging into Sportster — not directly through stripe.com. This is standard practice for marketplace platforms and is required by Stripe's Connect model.
  • You own your account and funds: All payout funds deposited into your connected bank account belong to you. Sportster does not have the ability to redirect your payouts to another account.
  • You cannot self-disconnect: To protect your own funds and prevent accidental loss of access, you cannot remove or disconnect your Stripe account from within the Sportster dashboard. If you wish to disconnect, contact support@sportsters.ca.
  • Your rights with Stripe directly: You may contact Stripe Support (support.stripe.com) at any time about your Express account, including to dispute any payout issues or request an account review, independently of Sportster.
  • By connecting a Stripe account, you agree to the Stripe Connected Account Agreement, in addition to these Terms.

Upon account termination or suspension: If your Sportster account is terminated or suspended, Stripe will process any remaining payouts (for bookings already completed) within 7 business days of the final booking payout date, subject to Stripe's standard payout schedule and any active refund or chargeback holds. You will retain access to your Express dashboard via a one-time login link which we will send to your registered email within 3 business days of termination, so you can download your payout history and tax documents.

6. Cancellations and Refunds

Cancellation policies are set by individual Venue Operators and are displayed prior to booking. Sportster's platform fee is generally non-refundable unless the cancellation is due to a Venue Operator error or force majeure. Refund disputes are handled through Sportster's dispute resolution process described in Section 9.

7. Venue Operator Responsibilities

Venue Operators are independent third parties. They are responsible for:

  • Holding all required business licences and permits
  • Maintaining adequate liability insurance (minimum $2M commercial general liability)
  • Ensuring venue safety and WorkSafeBC compliance
  • Accurately representing their venue, hours, and pricing
  • Collecting and remitting applicable taxes

Sportster makes no warranty regarding the accuracy of venue listings or the safety of any venue. Your use of a venue is at your own risk, subject to the liability waiver in your booking confirmation.

8. Limitation of Liability

To the maximum extent permitted by law, Sportster shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Platform or any venue booked through it. Sportster's total liability for any claim shall not exceed the amount you paid for the booking giving rise to the claim.

Nothing in these terms limits liability for fraud, death, or personal injury caused by our negligence, or any liability that cannot be excluded by law.

9. Dispute Resolution

We do not require mandatory arbitration. If you have a dispute with Sportster, you may:

  • Contact our support team at support@sportsters.ca to resolve informally
  • File a claim with the BC Civil Resolution Tribunal (CRT) for disputes under $5,000
  • Pursue a claim in BC Small Claims Court for disputes under $35,000
  • Pursue a claim in BC Supreme Court for larger disputes

This dispute resolution clause complies with the BC Business Practices and Consumer Protection Act (BPCPA) 2025 amendments, which prohibit mandatory arbitration clauses in consumer contracts.

10. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. You consent to the exclusive jurisdiction of the courts of British Columbia for any dispute arising under these Terms.

11. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or prominent notice on the Platform. Your continued use after notice constitutes acceptance of the updated Terms.
